  • The results obtained from using the Platform will be accurate or reliable
  • Any errors in the Platform will be corrected
  • The Platform is free of viruses or other harmful components

2. Intermediary Disclaimer

JobMyIndia operates as an intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000. In this capacity:

  • We provide a platform for employers and job seekers to connect. We do not directly employ, hire, or guarantee employment.
  • We are not responsible for the accuracy, legality, or completeness of job postings, employer information, or candidate profiles submitted by users.
  • We are not a party to any employment contract, agreement, or arrangement between employers and candidates.
  • We are entitled to the safe harbor protection under Section 79 of the Information Technology Act, 2000, subject to compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

3. No Guarantee of Employment

JobMyIndia does not guarantee or promise any employment, interview calls, or hiring outcomes to any candidate. The hiring decision rests solely with the employer. Similarly, we do not guarantee that employers will find suitable candidates for their vacancies.

4. AI-Powered Features Disclaimer

JobMyIndia uses Artificial Intelligence (AI) for various features including job matching, resume parsing, skill assessment, and recommendations. Please note:

  • AI-generated results are algorithmic suggestions and should not be considered as absolute recommendations or guarantees.
  • AI matching scores are indicative and may not perfectly reflect a candidate's suitability for a role.
  • Resume parsing and AI-assisted resume building may contain inaccuracies. Users should review and verify all AI-generated content before use.
  • We do not guarantee the accuracy, completeness, or reliability of any AI-powered feature.

5. Third-Party Links and Services

Our Platform may contain links to third-party websites, services, or resources. These links are provided for your convenience only. JobMyIndia:

  • Does not endorse, recommend, or assume responsibility for any third-party content, products, or services
  • Is not responsible for the availability, accuracy, or privacy practices of third-party websites
  • Is not liable for any damage or loss caused by or in connection with the use of any third-party content or services

6. Payment Disclaimer

Payments on JobMyIndia are processed through Razorpay, a third-party payment gateway regulated by the Reserve Bank of India (RBI). While we use industry-standard security measures:

  • We are not responsible for any loss or damage arising from payment gateway failures, technical errors, or unauthorized transactions not caused by our negligence
  • Users are advised to verify payment details before completing transactions
  • For payment-related disputes, our Refund Policy shall apply

7. HRMS Services Disclaimer

For employers using our HRMS (Human Resource Management System) features:

  • The HRMS tools are provided as a convenience and should not be the sole basis for compliance with labour laws
  • Employers are solely responsible for ensuring compliance with all applicable labour laws including the Factories Act, 1948, Shops and Establishment Acts, EPF Act, 1952, ESI Act, 1948, and any state-specific regulations
  • Payroll calculations are based on inputs provided by the employer. JobMyIndia does not guarantee the accuracy of payroll outputs if incorrect data is entered
  • Attendance records, leave calculations, and compliance reports generated through our HRMS should be verified by the employer before being used for statutory filings

8. Copyright and Intellectual Property

8.1 Ownership

All intellectual property rights in and to the JobMyIndia Platform, including but not limited to copyrights, trademarks, trade secrets, patents, and proprietary information, are owned by Stockup Fintech Pvt Ltd and are protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable Indian and international intellectual property laws.

8.2 Restrictions

Without our prior written consent, you may not:

  • Copy, reproduce, modify, or distribute any content from the Platform
  • Create derivative works based on our Platform or its content
  • Reverse engineer, decompile, or disassemble any software used in the Platform
  • Use our trademarks, logos, or brand elements in any manner without authorization
  • Scrape, harvest, or extract data from the Platform using automated tools

8.3 Copyright Infringement Reporting

We respect the intellectual property rights of others. If you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement on our Platform, please provide a written notification to our designated Copyright Agent in accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021:

8.4 Counter-Notice

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notice to our Copyright Agent. The counter-notice must include your identification, the content removed, a statement under penalty of perjury that the removal was a mistake, and your consent to the jurisdiction of the courts in Mumbai, India.

9. Fraud Warning

Important Notice for Job Seekers

  • JobMyIndia NEVER charges candidates for job applications or placements.
  • If any employer or recruiter asks you to pay money for a job, it is likely a SCAM. Please report it immediately to us.
  • Do not share your bank account details, OTP, or UPI PIN with anyone claiming to be from JobMyIndia.
  • Report suspicious activities to: report@jobmyindia.com or call our helpline.
  • You may also report employment fraud to the Cyber Crime Portal: cybercrime.gov.in

10. Compliance with Indian Laws

JobMyIndia is committed to compliance with all applicable Indian laws and regulations, including:

  • Information Technology Act, 2000 and IT Rules
  • Digital Personal Data Protection Act, 2023
  • Consumer Protection Act, 2019
  • Indian Contract Act, 1872
  • Copyright Act, 1957
  • Trade Marks Act, 1999
  • Payment and Settlement Systems Act, 2007

  • Prevention of Money Laundering Act, 2002
  • All applicable labour laws and employment regulations

11. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall JobMyIndia, Stockup Fintech Pvt Ltd, or their directors, officers, employees, agents, partners, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, goodwill, or other intangible losses, resulting from:

  • Your access to or use of, or inability to access or use, the Platform
  • Any conduct or content of any third party on the Platform
  • Any content obtained from the Platform
  • Unauthorized access, use, or alteration of your data

We may update this Disclaimer from time to time. We will notify users of material changes by posting a notice on the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Disclaimer.
